STATE TIMES NEWSKatra: Sandeep Singh Sen Munsiff Katra after hearing Advocate Vilakshan Singh in a suit filed by Parshotam Singh General Secretary of Shrine Board Employees Union Katra has temporarily restrained Shri Mata Vaishno Devi Shrine Board Katra from interfering into the working of the Shrine Board Employees Union.Parshotam Singh has challenged sub-Clause XXVI(b) of Clause 23 of Shri Mata Vaishno Devi Shrine Board Employees (Recruitment and other Conditions of Service) Bye-Laws, 1996 whereby the the Shrine Board has restrained its employees from forming Union or becoming members of a Union not recognized by the Board. In the suit filed before the Court of Munsiff Katra, the plaintiff has asserted that the right to form Unions and Associations is a fundamental right under Article 19(1)(c) of the Constitution of India. It has further been claimed by the plaintiff in his suit that by enacting the above said sub-clause, the Shrine Board has exceeded the legislative powers delegated on it by the Legislature under Section 24 of the Shri Mata Vaishno Devi Shrine Act, 1988. The plaintiff has further claimed in his plaint that the above said sub-clause was not part of the original By Laws but the same were enacted by the Shrine Board with an aim to curb the genuine demands of the employees of the Shrine Board. He also claimed that the Shrine Board is averse to the formation of unions by its employees and is resorting to unconstitutional means to suppress the voice of its employees. It has also been claimed in the suit that Shrine Board Employees Union Katra is a registered Trade Union and was registered in the year 1990 i.e. more than 30 years back. Since then it was conducting its operations smoothly but all of sudden, the Shrine Board started interfering into the working of Shrine Board Employees Union by not allowing members of the Union to conduct its meetings and by threatening to take disciplinary action in case employees of the Board participated in the meetings of the Union. The higher officials of the Shrine Board were pressurizing the plaintiff to dissolve Shrine Board Employees Union on the pretext that it was not recognized by the Shrine Board. The order passed by the Munsiff Katra has given much relief to the members of Shrine Board Employees Union Katra.
