JAMMU: Supreme Court Collegium led by Chief Justice has cleared name of Senior Advocate Rahul Bharti from Advocate quota for elevation as Judge to J&K High Court.It is worthwhile to mention here that in March 2019, the State High Court Collegium had recommended Rahul Bharti for appointment as Judge of the Jammu & Kashmir. As per precedence, the Supreme Court Collegium will take decision on the recommendation of the J&K High Court Collegium and then forward names to the Union Ministry of Law and Justice for clearance. Later, the list will be submitted to the Prime Minister’s Office for final approval of the Union Government and thereafter to the President of India for issuance of the warrant of appointment.As per the Memorandum of Procedure in vogue, lawyers with minimum 10 years of experience in practice and falling in age-group of 45-55 years are considered for post of High Court Judge. Two-third of the sanctioned strength of a High Court is reserved for Bar and one-third for Bench.The J&K High Court has sanctioned strength of 17 Judges including 13 Permanent Judges and 4 Additional Judges. However, at present there are 11 Judges including Chief Justice Puneet Mithal. The other Judges of the High Court are Justice Ali Mohammad Magrey, Justice Dhiraj Singh Thakur, Justice Tashi Rabstan, Justice Sanjeev Kumar Shukla, Justice Sindhu Sharma, Justice Rajnesh Oswal, Justice Vinod Chatterji Koul, Justice Sanjay Dhar and Justice Javed Iqbal Wani.Adv Rahul Bharti, son of Late Kailash Nath Sharma was born on July 31, 1967 and did his B.Sc from GGM Science College Jammu, LL.B from Himachal Pradesh University, Summer Hills, Shimla. Sr Adv Rahul Bharti joined Bar in February 1991 upon being provisionally enrolled as an advocate with Bar Council of Jammu & Kashmir vide notification no. 64- A dated February 7, 1991 and later enrolled on Rolls of Advocates vide Certificate of Enrolment number 42-(A)/1991 dated February 22, 1993. Presently, he has standing of more than 28 years at Bar having conducted and conducting cases on original, civil as well as criminal side, and also on appellate and writ jurisdiction side. He had conducted and handled litigation of varied nature such as Industrial, Labour, Consumer, Cooperative, Revenue, Motor Accidents Claims, Banking, Taxation (excluding Income Tax), Arbitration & Service matters. Rahul Bharti was designated as Senior Advocate of J&K High Court on December 15, 2020.
