DB imposes costs Rs 15000 for not filing status report on Artificial lake

JAMMU: In a Public Interest Litigation filed by Inderjeet Khajuria President All Jammu Hotels and Lodges Association Jammu espouses public causes including creation of Artificial Lake in River Tawi and Gandola Project from Mubarak Mandi to Bahu Fort, a Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Rajesh Bindal granted one more opportunity to the respondents to file the status report subject to payment of personal costs of Rs 15,000 by the Commissioner/Secretary, Irrigation, Flood Control & PHE Department.
When the PIL came-up for hearing, Division Bench observed that this Public Interest Litigation is pending before this court since 2014 with regard to the completion of the project of Artificial Lake in river Tawi; laying down of the Gandola project from Mubarak Mandi to Bahu Fort; and beautification of the areas and related issues.
Division Bench had on 16th March 2020 directed the respondents to place before us the latest status report with regard to these projects but this has not been done despite passage of about seven months.
Upon this, DB grants one more opportunity to the respondents to file the status report subject to payment of personal costs of Rs 15,000 by the Commissioner/Secretary to Govt., Irrigation, Flood Control & PHE Department.
The costs shall be deposited with the Advocate’s Welfare Fund within a period of one week. Proof of deposit shall accompany the status report which shall be filed within four weeks from today.
