Cousin convicted in molestation case


JAMMU: A cousin who is facing trial in molestation case has been convicted by the Court. Sub-Judge Bhadarwah Sumati Sharma has granted one year imprisonment to Sanjay Kumar, who happens to be maternal uncle’s son of prosecutrix.
According to police case, on August 4, 2020, the complainant of case prosecutrix lodged a written application before Police Station Bhadarwah stating therein that she is a resident of Village Narnu, Tehsil Bhadarwah. She further stated that on August 3, 2020 at about 11:30 AM, she went to her kitchen garden for bringing vegetables and that place is about 200 meters away from her house. She further said that accused Sanjay Kumar, son of Hans Raj, resident of Narnu with a criminal intention was already hiding there and when she reached there, accused Sanjay Kumar held her arm, took away her Dupatta and tried to close her mouth with it. Her father, who had been unwell for a long time and her grandmother, were in the house. When she raised her voice to rescue herself, her real brother who was working as a labourer at someone’s house in Narnu, came there. On seeing him, accused Sanjay Kumar fled away with the Dupatta. She further complained that she has apprehension of her life from accused Sanjay Kumar. On basis of the written complaint, FIR for the commission of aforesaid offences were registered and investigation of case commenced. After the completion of investigation, the accused was found involved in the commission of aforesaid offences.
Sub-Judge Bhadarwah Sumati Sharma, after hearing APP Rajeev Thappa for the UT, whereas Adv Sunil Sharma for accused, observed that the nature of offence and increasing crime against women, the accused is not considered for extending benefits of Probation of Offenders Act. However, as it has not come on record about any criminal antecedent or history, the Court awarded one year’s imprisonment to accused in molestation case.
