STATE TIMES NEWSJAMMU: Additional Sessions Judge Kathua Kamlesh Pandita rejected bail application of one Mohd Ashraf Sheikh, who is a drug dealer.As per details of case, Challan was presented before the court by way of transfer on May 12, 2021 against two accused persons while their co-accused namely Wazir Chand has been absconded. As per the allegations against accused, on November 17, 2020, a party from Police Station Hiranagar led by SI Arun Slathia were on patrol duty at Dayalachak near Railway bridge. During patrolling, at about 18:15 Hours, a person was noticed going towards Dinga Amb from Dayala Chak with a bag on his shoulder, who on seeing police party, tried to give slip to police but was nabbed by alert cops. The suspect disclosed his name as Dilbagh Singh, son of Baldev Singh, resident of Katli and during search, 500 grams of heroin was recovered from his possession. On this, FIR No.114/2021 was registered against accused under Sections 8/21/22 of NDPS Act. The accused was detained and investigation was set into motion. During course of investigation, it came to fore that Dilbagh was hand in glove with other co-accused including applicant, who by way of abetment and in furtherance of criminal conspiracy , were neck deep involved in drug trafficking. Consequently offence under Section 29 of NDPS Act was also slapped on the accused persons.Additional Sessions Judge Kathua Kamlesh Pandita, while rejecting bail application, observed that drug traffickers like accused are spreading addiction of narcotics & psychotropic substances among human race, especially youth section of society making them slaves of the same. “The innocent youth, when become addicts, not only spoil their lives but also ruin lives of their family members. Therefore, the release of such accused person at this stage will not meet the ends of justice. Consequently, as per facts and circumstances of the instant case, the apprehension of the prosecution appears to be reasonable that once accused is admitted to bail, he will not debar himself from tampering with evidence, repeating offence and hindering the further trial in the case also,” he observed and rejected the bail application.
