Court can’t substitute opinion regarding fixing of age limit: HC

SRINAGAR: In a petition filed by Dr Shahnaz Rasool challenging condition of an Advertisement Notice No.SHS/NHM/J&K/CPHC/AD/ 1799-1806 dated December 21, 2020, to the extent that it prescribes January 1, 2021 as the date for reckoning maximum age limit.
A further direction has been sought upon the respondents to reckon maximum age of petitioner from 1st day of January, 2020, as mandated in terms of Article 37 of Jammu & Kashmir Civil Service Regulations. The petitioner has also sought directions to the respondents to appoint/ engage her against a post sought to be filled up in terms of aforesaid Advertisement Notice.
Justice Sanjay Dhar, after hearing both the sides, dismissed the petition with the observations that Court cannot substitute its opinion with regard to the matter relating to fixing of age limit or fixing of date of reckoning of age limit for undergoing different academic and professional courses.
