JAMMU: Principal Sessions Judge Rajouri Jaffer Hussain Beigh awarded seven years rigorous imprisonment to Attinder Pal Singh, a BSF cop facing trial in a rape case.According to Police case, on July 15, 2016 the complainant, Satvir Kour submitted a written report to Incharge Women Cell Rajouri ordered by Special Mobile Magistrate Rajouri under Section 156 (3) CrPC against accused Attinder Pal Singh with averments therein that accused is a Government servant in 125 Bn BSF and she is resident of Nowshera. The accused enticed her by promise of marriage and developed sexual relationship with her. She further alleged that in 2015, the accused committed rape on her due to which she conceived. The accused brought a medicine for her abortion with promise that after abortion, he will marry her on October 1, 2015. The accused forcibly administered tablets to her due to which abortion took place. She was called by accused to Akhnoor and then at direction of the accused, she went back to his house. On October 20, 2015 the accused called her at Rajouri, took a room on rent and again raped her in that room. In this way the accused used to commit rape upon her but not marrying her. The accused also abused and threatened her to death. She further requested that as accused has committed crime, so action under law be taken against him. On this application, FIR No.06 of 2016 stood registered in Women Police Station Rajouri for offences under Sections 376 and 312 RPC.Principal Sessions Judge Rajouri Jaffer Hussain Beigh, after hearing both the sides, observed that accused Attinder Pal Singh was convicted for commission of offence punishable under section 376 (1) RPC. Now regarding imposition of sentence upon accused, the nature of the offence, circumstances of its commission, age and character of the offender, injury to individual or the society, effect of the punishment on offender, are some amongst many other factors which would be ordinarily taken into consideration by the Court. “The offence under section 376(1) RPC committed by the accused is punishable with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term, which may extend to ten years, and shall also be liable to fine. The trial, in this case, has taken about four years and accused is an Army official who would lose his job after his conviction in the case. For these reasons, I sentence the accused, namely, Attinder Pal Singh to undergo rigorous imprisonment for seven years and to pay a fine of Rs.10,000 and in default of payment of fine he shall further undergo imprisonment of like nature for 6 months,” he observed.
