Anita Sharma impersonates ownership of sold plot to construct illegal building at 44 D/C Gandhi Nagar



JAMMU: In a bizarre case of outwitting the designated government agency by adopting fraudulent modus operandi, in connivance with some insiders, a massive construction is underway in the posh Gandhi Nagar area of the Capital City Jammu in absence of a valid building permission by Jammu Municipal Corporation.
The violator, according to sources, has adopted a diversionary tactic by getting into litigation to avert and delay the legal process of fraud and violation.
According to reports, one Anita Sharma, wife of Shiv Kumar Sharma, resident of 23 B/C Gandhi Nagar purchased a plot of land at 44 D/C, Gandhi Nagar on April 25, 2018 for Rs. six crores. She paid the cash vide Cheque No.029516 on April 5, 2018, Cheque No .029519 on April 12, 2018 for crore and the third Cheque No. 029524 on April 16, 2018 for Rs.3.14 crore. An amount of Rs 6 lakh as TDS @ 1 per cent was deducted over all cheques payable at YES Bank, Gandhi Nagar, Jammu

After purchase of the property, the owner Anita Sharma applied to Jammu Municipal Corporation for Building Permission on August 22, 2019, which had already been sold to someone vide two sale deeds. However with malafide intention to commit fraud, the site for the proposed construction was reflected Plot No.84/110-A Block (Pvt) Gandhi Nagar Jammu instead of Plot No 44/DC Gandhi Nagar.
In her application to the JMC for the building permission on August 22, 2019, Anita Sharma impersonated herself as the owner of Plot No.84/110-A despite the fact that she had already sold this plot (Plot No. 84/110 A) to someone vide two ‘Sale Deeds’ on December 26, 2015 and September 28, 2018 respectively after taking full and final payment. Accordingly, she was no more the owner of the sold building on August 22, 2019.
As expected, Jammu Municipal Corporation rejected the application of Anita Sharma, seeking building permission, on February 20, 2020. However, the construction on Plot No 44 D/C went on unabated, by befooling the JMC staff by saying that she has already applied to the Corporation for approval. That there was no permission for construction at all came to light when the matter came to the notice of the JMC, which intimated in a reply to R.T.I, that no Building n Permission had been granted for construction of a building on Plot No 44 D/C Gandhi Nagar ( copy on page No..9).
Meanwhile, Anita Sharma raised a huge building on Plot No. 44 D/C in violation of all the norms including of the ‘setbacks’.

Intriguingly, when the scandal was exposed, Jt. Commissioner, Jammu Municipal Corporation issued a notice to Anita Sharma, wife of Shiv Kumar Sharma, 23 B/C for carrying out minor violations, notwithstanding the fact that a huge two storey building was constructed illegally with violation of Set Backs too.
Meanwhile, the J&K Tribunal stayed the notice of May 31, 2021, issued by the Jt. Commissioner for minor violations, and the case continues to be sub-judice.
According to the sources, the JMC is delaying in submission of records as sought by the Tribunal on every date of hearing.
